Opening statements began Tuesday morning in Jefferson County in the capital murder trial of Gabe Watson. Mr. Watson is being accused of killing his wife, Tina Watson, while on their Australian honeymoon in 2003.

Prosecutors argue that Gabe Watson killed her so he could gain insurance benefits totaling over $200,000. Defense attorney, Brett Bloomston, explained to jurors that Mrs. Watson's death was an accident. He explained that the death resulted from both of them being inexperienced divers at a dangerous dive site and that the accusation that Mr. Watson benefited from his wife's death is completely unfounded.

In a recording, Gabe Watson is heard stating that his wife panicked and that the increased weight in her dive belt prevented her from reaching the surface. Watson stated that he attempted to rescue her himself, but was unable. He states that he quickly went to the surface and attempted to seek help.

Gabe Watson has already served over a year in an Australian prison after he pled guilty to negligent manslaughter.

Because he was prosecuted and convicted in Australia, the State of Alabama can only charge him if they prove that a part of the crime took place in Jefferson County. Therefore, if the State can make this link, Gabe Watson may face the death penalty or life in prison without parole if convicted.
