DUI Manslaughter Conviction Lands Ex-Police Officer 12 Years

The Alabama Court of Criminal Appeals has upheld the conviction of James Kendrick, a former Birmingham Police Officer, for reckless manslaughter. In November 2009 James Kendrick was estimated to have been travelling at over 120 miles per hour on Interstate 20/59 when he collided with Derric Rush. Kendrick's blood alcohol content

was estimated to be between .14-.17, well exceeding the legal limit of .08. Derric Rush was tragically killed in the accident where he was ejected from his convertible.

Driving under the influence is a highly politicized problem in Alabama and increasing penalties have been discussed and enacted by the legislature in recent years. An estimated 40,000 Alabamians will be arrested for DUI this year and many will either plead guilty or face the situation alone without an attorney. Pleading guilty can have serious consequences including jail time, driver's license suspension, high insurance rates, and a criminal record that could affect your career and education opportunities. If you or someone you know has been arrested for DUI contact an experienced DUI defense attorney.
