Birmingham man charged with kidnapping

There are times when disagreements get blown out of proportion. That may have been the case recently in Birmingham when a dispute between two parents turned into what police are calling a hostage situation.

Police were called to a home on Elm Street Southwest on the evening of Aug. 24 for an apparent domestic violence situation. Police claim that when they arrived at the home a man shut the front door on them and would not come outside. A woman was also allegedly trapped in the home with the man. Police say a witness told them they heard a gun go off.

Police say they tried to make contact with the man inside the home. However, when they weren't successful, they fired tear gas into the home. The woman came out of the home around 6 a.m. The man was forced out of the home 25 minutes later when authorities used more tear gas.

No one was injured in the incident. However, the man has been charged with kidnapping. Days after the incident he remained behind bars. Bond was set at $200,000.

It is not clear what led to the alleged dispute. However, reports indicate that the man and woman have a child together.

Although the witness said they heard gunfire from inside the home, the man does not face any weapons-related charges. As we've discussed in previous posts, witness testimony is not always reliable. Authorities and prosecutors should, therefore, base their case on solid facts.

When someone finds themselves facing serious criminal charges, like the man in this case, it is best to rely on the expertise of an experienced criminal defense attorney.
