Man arrested and charged with DUI after questioning sheriff's deputy

People who are convicted of drunk driving could face serious penalties. A man from Birmingham could soon learn how severe those penalties may be after he was arrested and charged with DUI earlier this month.

According to one report, a 41-year-old man was driving his car in Jefferson County when he abruptly stopped. He then got out of the car and asked a sheriff's deputy, who was following closely behind, why the deputy was following him. Although the man returned to his vehicle, the deputy ordered him to stay put.

The deputy reportedly called for assistance. When others arrived, the driver and his two passengers were arrested.

The driver was charged with DUI. A 33-year-old passenger was charged with public intoxication, and a 28-year-old passenger was charged with first-degree possession of marijuana. Sheriff's deputies claim the 28-year-old threw a bag of marijuana out of the car before he was arrested. That same man is reportedly wanted in another city on unrelated charges.

People may think that this would be an easy case for prosecutors to handle. However, that may not be true. It would be wise for a criminal defense attorney to investigate the details of the arrest. After all, authorities must follow certain procedures. If those procedures were not properly followed, an individual's rights may have been violated.
