Woman charged with DUI after falling asleep at intersection

Earlier this month, Birmingham police were called to the intersection of 41st Street and Messer Airport Highway around 8:15 a.m. after receiving a report that a woman had been shot in her vehicle. However, when they arrived, they discovered a very different situation.

After arriving on the scene, authorities say they discovered that the woman had not been shot, but was instead asleep in her car wearing a Halloween costume. She was apparently dressed as a pregnant zombie and covered in fake blood.

Police say they were able to wake the woman. She was removed from her car and arrested. She now faces charges for allegedly driving under the influence.

In Alabama, a drunk driving conviction can result in serious penalties, including time behind bars, large fines and driver's license suspension or revocation. Because of the potentially harsh consequences, the woman in this situation, and others who face similar charges, would be wise to begin planning a strong criminal defense against the charges.

In some instances, it may be wise to question the tactics used by law enforcement. Although people assume Breathalyzer tests are foolproof, improper use could result in inaccurate readings.
